Please read these Terms carefully before booking or attending any session. By using FinLit's website, booking a session, or participating in any coaching or educational session, you agree to be legally bound by these Terms of Service. If you do not agree, do not use our services.

1About FinLit

FinLit ("FinLit," "we," "us," or "our") is a financial literacy education service operated by Zev Kalmanson, based in California. FinLit provides one-on-one educational coaching sessions for teenagers and young adults covering topics including but not limited to budgeting, saving, credit, investing basics, and taxes.

FinLit is an educational service only. We are not a registered investment adviser, broker-dealer, financial planner, licensed financial adviser, CPA, or attorney. Nothing provided through FinLit constitutes personalized investment advice, legal advice, tax advice, or any form of regulated financial service under federal or state law.

2Nature of Services — Educational Purposes Only

2.1 Educational Content Only

All content, materials, sessions, resources, tools, and communications provided by FinLit are strictly for general financial literacy education purposes only. FinLit teaches financial concepts and general principles. We do not provide personalized financial advice, investment recommendations, or professional services of any kind.

2.2 Not Financial Advice

The information provided through FinLit sessions, materials, or communications: is not a substitute for advice from a licensed financial adviser, investment adviser, certified financial planner (CFP), CPA, or attorney; does not constitute personalized investment advice under the Investment Advisers Act of 1940 or any applicable state law; is not tailored to your specific financial situation, investment objectives, risk tolerance, or tax circumstances; and should not be relied upon as the sole basis for making any financial, investment, tax, or legal decision.

2.3 No Advisor-Client Relationship

Your use of FinLit's services does not create a fiduciary relationship, investment adviser-client relationship, attorney-client relationship, or any other professional relationship that gives rise to a duty of care beyond that of an educator providing general financial literacy education.

2.4 Consult a Licensed Professional

We strongly encourage all clients to consult with licensed professionals — including but not limited to a certified financial planner (CFP), registered investment adviser (RIA), licensed CPA, or licensed attorney — before making any significant financial, investment, tax, or legal decisions.

3Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FINLIT'S SERVICES, MATERIALS, AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: warranties of merchantability or fitness for a particular purpose; warranties that educational content is accurate, complete, current, or free from error; warranties that any financial concept, strategy, or general principle discussed will produce any particular result when applied to your personal financial situation; and warranties that financial markets, tax laws, regulations, or economic conditions referenced in sessions will remain unchanged. Financial markets, tax laws, regulations, and economic conditions change frequently. Information provided during sessions reflects general knowledge at the time of delivery and may not reflect subsequent changes.

4Limitation of Liability

4.1 No Liability for Financial Outcomes

FinLit, its owner, employees, contractors, affiliates, and representatives shall not be liable for any financial loss, investment loss, missed financial opportunity, economic harm, or any other damages — direct, indirect, incidental, consequential, special, exemplary, or punitive — arising from or related to: any financial decision you make after attending a FinLit session; any reliance on information, concepts, or general principles discussed during sessions; any investment, savings, credit, tax, or budgeting decision made based on educational content provided by FinLit; any fluctuation in the value of assets, investments, or accounts opened as a result of concepts discussed in sessions; any failure to achieve desired financial goals or outcomes; or any third-party products, services, platforms, or financial institutions mentioned or referenced during sessions.

4.2 Maximum Liability Cap

To the fullest extent permitted by applicable law, FinLit's total aggregate liability to you for any claim arising from or related to our services shall not exceed the total amount you paid to FinLit in the ninety (90) days preceding the event giving rise to the claim.

4.3 Assumption of Risk

You expressly acknowledge and agree that all financial decisions you make are your own and are made at your sole risk and discretion. You assume full responsibility and liability for all financial decisions and their outcomes, regardless of whether those decisions were influenced in any way by information shared during FinLit sessions.

5Indemnification

You agree to indemnify, defend, and hold harmless FinLit and its owner, employees, contractors, affiliates, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of FinLit's services; any financial decision you make based on or following FinLit sessions; your violation of these Terms of Service; your violation of any applicable law or regulation; or any claim that information you provided to FinLit is false, misleading, or inaccurate.

6Payment, Cancellation & Refund Policy

6.1 Session Fees

Sessions are priced at $50 per 45-minute session unless otherwise agreed in writing. The first introductory session is complimentary and provided at no charge. Fees are subject to change with reasonable notice.

6.2 Payment Terms

Payment is due at the time of booking. Sessions are confirmed only upon receipt of payment. We use third-party payment processors (including Stripe) to process payments. By providing payment information, you agree to the terms of those third-party processors.

6.3 Cancellation Policy

Cancellations made 24 or more hours before the session: full refund or free reschedule. Cancellations made less than 24 hours before the session: 50% refund; the remaining 50% is forfeited. No-shows with no notice: full session fee is charged with no refund. FinLit reserves the right to cancel or reschedule sessions due to illness, emergency, or other unforeseen circumstances, in which case clients will receive a full refund or reschedule at their preference.

7Booking & Session Conduct

By booking a session, you represent that: you are at least 13 years of age, or a parent or guardian is booking on your behalf; if booking on behalf of a minor, you are the minor's parent or legal guardian and consent to these Terms on their behalf; all information provided in the intake form and during sessions is truthful and accurate to the best of your knowledge; and you will participate in good faith and use educational content responsibly. FinLit reserves the right to terminate any session at its discretion if conduct is inappropriate, abusive, or otherwise contrary to the spirit of a professional educational environment.

8Intellectual Property

All session materials, resources, guides, calculators, presentations, and other content provided by FinLit are the intellectual property of FinLit and its owner. You are granted a limited, non-exclusive, non-transferable license to use these materials for your personal financial education only. You may not reproduce, distribute, sell, or publicly share FinLit materials without express written permission.

9Third-Party References

FinLit may reference third-party financial products, platforms, institutions, or tools during educational sessions as examples of commonly-used tools. Such references are for educational illustration purposes only and do not constitute an endorsement, recommendation, or affiliate relationship. FinLit receives no compensation for mentioning any third-party product or service unless explicitly disclosed.

10Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or the services provided by FinLit shall first be submitted to good-faith mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Santa Clara County, California. You waive any right to participate in a class action lawsuit or class-wide arbitration against FinLit.

11Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

12Changes to These Terms

FinLit reserves the right to update or modify these Terms at any time. Material changes will be communicated by updating the "Last Updated" date at the top of this document and, where appropriate, by direct notification. Continued use of FinLit's services after changes constitutes acceptance of the revised Terms.
